Allergan Hit With $600 Million Settlement Over Botox

Allergan Inc. reached a $600 million settlement with the U.S. government to resolve criminal and civil allegations that the company actively promoted its top-selling product, the wrinkle-smoothing drug Botox, for unapproved medical uses. The Irvine, Calif., company agreed to plead guilty to one misdemeanor charge pegged to misbranding the drug between 2000 and 2005. Allergan also settled civil claims linked to three whistleblower lawsuits, but denied liability with regard to the civil claims. The company will take a $610 million to $615 million pretax charge in the third quarter.

Allergan and many other drug companies promote their drugs for non FDA approved uses. Maybe Allergan was more aggressive about it. Off label use is pretty typical for botulinum toxins and most of these are pretty safe. The law doesn’t always make much sense.

Keira Knightly Fights Against Photoshop Boob Job

Keira Knightly is fighting to keep producers from computer-enhancing her bust on movie posters for her new movie. This is remarkable as the computer enhancement probably would cost more than the real thing in her case. She seems to feel strongly about it. Breast enhancement of any sort is a personal issue indeed. Good for her.

Sharon Osbourne Removed Breast Implants


Sharon says that she is going to have the one implant made into a paper weight for Ozzy to keep next to his bed, and the other one she is going to give to her pal Gary Farrow to use as a way to relive some stress, nothing like a friend squeezing your breast to relive some stress.

I have had patients make more interesting requests regarding their old implants. Sometimes the implants are not in a condition in which you can do much with them. Old silicone implants kinda turn into a gooey mess with a crispy coating. That’s why I am pro-saline.

On Sharon’s stress relief gag, I have never seen a breast implant as all that interesting without a woman attached.

Florida Liposuction Death & Finding Safe Lipo

A 35-year-old woman who wanted to resculpt herself for the new year with liposuction and a buttocks enhancement is dead from apparent complications of plastic surgery, her husband and lawyer said Thursday. Miami customer service representative Lidvian Zelaya died Monday, hours after the operation began at Strax Rejuvenation and Aesthetics Institute, a busy cosmetic surgery practice in Lauderhill. Zelaya went to Strax to have fat suctioned from her back and belly, and to have the material injected into her backside, family representatives said. She chose Strax because she got a good deal. Aronfeld said the operation was to be done by Dr. Roger L. Gordon. He was disciplined by the state in connection with two plastic surgery deaths in 2004.

This is getting ridiculous. Liposuction deaths have been frequent in the media as of late. And this surgeon Roger L. Gordon MD is a real board-certified plastic surgeon as per the American Board of Medical Specialties.

Then again plastic surgery is surgery and therefore has risk associated with it. Was this an unfortunate accident or something else? How can a potential patient choose well to limit the risk of cosmetic surgery?

I put up a brief surgeon credentialing section on my site years ago and there is part on looking up the doctor on the ABMS site. There is also a section on checking the doctor with the State Medical Board. In this case that State Medical Board is represented online by the Florida Department of Health. Most State Medical boards have listings at which doctors can be checked. Medical Board disciplinary actions and malpractice case settlements are sometimes included in these listings.

When we type “Roger L Gordon” into the Florida Department of Health site, we get a listing showing eight public complaints and three board disciplinary actions. I’d say that is a red flag.

There is no one criterion that tells you a doctor is going to be OK and he might not have done anything wrong in this case. But there is a need for patients to be informed about the training and history of a potential surgeon. Do you think this patient might have chosen differently if she had known this before her operation?

Mischa Barton’s $95,000 Nursing Bill

Mischa Barton has reportedly been ordered to pay nearly $90,000 (£56,000) in medical expenses after a heathcare company allegedly sued the actress over an unpaid bill from 2009. The O.C. star suffered a traumatic time that year (09) – she was hospitalized and placed on an involuntary psychiatric hold, later blaming the meltdown on botched dental surgery.

This “private nursing” was probably home nursing care. Why she employed the service in 2009 is open to question. It is possible she employed them to assist her in keeping her medical condition quiet and allowing her to stay at home. Was this for plastic surgery? Not necessarily.

Why the service kept providing her care without securing payment is beyond me. She was ordered to pay $95,000 on the bill because interest was added.

Woman Gets Jail Time for Embezzling Breast Implant Money

A former executive assistant for the La Habra Boys and Girls Club was sentenced today to three years in prison for embezzling about $135,000 from the organization over two years, using some of the stolen money to pay for breast implants. Superior Court Judge Roger Robbins also ordered Lynette Rojas to pay $270,000 in fines and $165,113.08 in restitution to the club. But the 37-year- old La Habra residents appears unable to pay any of the money back, Deputy District Attorney Marc Labreche said. Rojas, who could have faced up to 20 years in prison if convicted at trial, pleaded guilty April 4 after Robbins agreed to sentence her to three years behind bars.

Lynette Rojas stole $135,000 from the Boys and Girls Club of La Habra and used part of the money to have breast implant surgery. She took a plea deal as opposed to going to trial. I wonder if her surgeon had to pay back the money she paid him.

Student Makes Life-Size Barbie – Blames for Body Dysmorphism

Galia Slayen, the student who transformed the iconic Mattel toy into a life-size replica model, says that Barbie’s build helps accelerate “a drive for thinness,” claiming that the doll was one of many factors in her own personal struggle with body image and an eating disorder.

We have discussed Barbie, the doll that has been blamed for much that is wrong with body image in America before. We discussed a woman who supposedly was inspired by Barbie to have a good deal of plastic surgery. How many of our own problems can we really blame on anyone (or thing) other than ourselves though?

This time a student re-created a life size Barbie, which seems to have a small head by my view, to blame it in part for her problems with body image. A person who identifies with a piece of plastic to the extent that that relationship drives behavior is a bit on the questionable side I think. Where were her parents during this time? While political correctness calls upon us to consider this woman a victim, I think we need to accept personal responsibility for our actions and not point fingers everywhere (and at everyone) other than ourselves.

Than again, this might have just been a publicity stunt.

Amy Winehouse And Her Paronychia

Amy Winehouse like many celebs gets photographed a lot. It is rare on a photograph that we see a probable hand infection. Here she may have a paronychia, an infection along the border between the nail and the skin at the side or the base of a finger or toenail.

These things usually hurt and may need to be drained.

Tustin Hospital “Monkey Business” No Surprise


A former Tustin Hospital executive pleaded guilty Tuesday to paying kickbacks to recruit homeless people who underwent unnecessary treatment billed to Medicare.

I used to use Tustin hospital years ago for Tummy Tuck surgery back before I started using pain pumps and the patients required hospital admission. There was a case in which my office arranged payment up front with the hospital. The patient paid for her hospital and operating room charges on the day of surgery, but still a few months later the hospital had billed Medicare and her secondary for tens of thousands of dollars. I remember calling the hospital CFO and getting an argument. The patient reported the incident to Medicare and we curtailed our use of the hospital and their surgical center.

When reports like this come out, sometimes it is not all that surprising.
